Traffic Violations
Traffic Defense Attorney
Pleading guilty to a traffic offense can often result in points, fines, increased insurance premiums, departmental hearings and loss of license. Some may tell you that it is a waste of time fighting a traffic violation and the judge will side with the police every time. Although traffic violations are referred to as “strict liability crimes” which means if you violate the law you are strictly held accountable, the police still have the burden to prove each element of their case beyond a reasonable doubt. When I evaluate your case I will come up with a detailed strategy to fight your traffic offense.
In your typical speeding case, here a few questions I might ask to determine the best way to fight your speeding ticket:
- Was the officer’s radar obstructed in any way by any physical objects?
- Was there a heavy flow of traffic? Is it possible the speed timing device measured the speed of another vehicle?
- Was the officer’s view obstructed in any way?
- Is the speed timing device the officer is using certified as accurate?
- Did the officer test the device for accuracy before using it?
- Is the officer properly certified in the radar or laser device he is using?
- What training has the officer had in using this device?
- Were the speed limits properly posted?
- Are the speed limits in this area properly justified by an engineering study or speed survey?
These are only a few tactics that I might use to fight your ticket. Contact my office for a free consultation if you were issued an unlawful speeding ticket that you would like to contest.
Every case counts.
I take every one of my client’s cases seriously whether it’s a felony narcotics case or a mere speeding ticket. I am a competitive person by nature and take losing personally. I strive to be the best in my field and always give 110% in the courtroom no matter what kind of case I am working on.
I also understand that the cost of legal fees can be more than simply paying the traffic ticket. However, by pleading guilty to the citation you are setting yourself up for years of increased insurance premiums. I try to set my fees as reasonable as possible to make it feasible for the citizens of southeastern, PA to fight unjust traffic citations.
